1. Information on data protection for the processing of personal data through this website

The personal data that you provide to Instare Legal through this website, or any of the means of contact that are available, may be processed for the purpose that corresponds to the reason for which you provided them.

Thus, the data provided may be used for the following purposes, depending on the reason for which you provide it:

Information requests.

  • Means: manage and respond to information requests
  • Lawful basis: consent, art. 6.1.a GDPR.
  • Retention period: the data will be used exclusively to answer your questions and will subsequently be deleted. The deletion period will be a maximum of 6 months from the last contact with the requesting user.
  • Recipients: the data will not be transferred to third parties except under legal obligation

Budget requests.

  • Means: prepare, deliver/send the budget, as well as to carry out follow-up and commercial prospecting actions, by telephone, telematics or in person.
  • Lawful basis: performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract, art. 6.1.b. GDPR.
  • Retention period: until the end of the current legal deadlines related to the conservation of tax and accounting data.
  • Recipients: the data will not be transferred to third parties except under legal obligation.

2. Processing of personal data through forms or documents that redirect to this privacy policy:

Purposes for the processing of data.The personal data collected in the different documents or forms that redirect to this privacy policy, as expanded information on data protection, may be processed

Billing

  • Purpose: to manage the contractual or pre-contractual relationship between you and Instare Legal, as well as for administrative, tax and accounting management.
  • Lawful basis: performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract, art. 6.1.b. GDPR.
  • Retention period: during the time required by current legislation in civil, financial and tax matters.
  • Recipients: if necessary, the data may be communicated to the competent Public Administrations, banks and savings banks

Budget, offers and projects management

  • Purpose: prepare, deliver/send the budget, as well as to carry out follow- up and commercial prospecting actions, by telephone, telematics or in person.
  • Lawful basis: performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract, art. 6.1.b. GDPR.
  • Retention period: until the end of the current legal deadlines related to the conservation of tax and accounting data.
  • Recipients: the data will not be transferred to third parties except under legal obligation.

Email and agenda management

  • Purpose: respond to specific requests for information, via email or telephone; manage the contact list; performance of contracts or pre- contractual measures.
  • Lawful basis: consent, in the case of requests for information or queries (art. 6.1.a GDPR), application of pre-contractual measures or performance of a contract (art. 6.1.b GDPR), and legitimate interest in the processing of data of persons of contact (art. 6.1.f GDPR).
  • Retention period: the data will be kept to the extent necessary to comply with the legal obligations arising from the existing relationship. Once extinguished, the data will be deleted.
  • Recipients: the data will not be communicated to third parties except under legal obligation.

Contracts (data related to signatories and contact persons)

  • Purposes: the personal data of the signatories of contracts, in cases where they are a natural person or in the case of representatives of a legal entity, will be processed in order to formalize the contract and carry out its development. The data of employees of the parties will also be processed for this latter purpose.
  • Lawful basis: performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract, art. 6.1.b. GDPR.
  • Retention period: until the end of the current legal deadlines related to the conservation of tax and accounting data.
  • Recipients: the data will not be transferred to third parties except under legal obligation.

Forms and requests made on behalf of companies.

  • Finalidad: the personal data of the signatories of contracts, in cases where they are a natural person or in the case of representatives of a legal entity, will be processed in order to formalize the contract and carry out its development. The data of employees of the parties will also be processed for this latter purpose.
  • Lawful basis: legitimate interest of Instare Legal to process data of contact persons and legal representatives in accordance with art. 19 LOPD 3/2018.
  • Retention period: until the end of the current legal deadlines related to the conservation of tax and accounting data.
  • Recipients: the data will not be transferred to third parties except under legal obligation.

3. Third-parties data

If during your communications with Instare Legal you provide data of third parties, we inform you that:

  • You can only provide us with data from third parties if you have their express consent. Therefore, by sending us data from third parties, you declare that you have the aforementioned consent, or that you have the legal capacity to express said consent on their behalf.
  • All people about whom you send us data must know the content of this privacy policy. You state that you have informed them and made their content known.
  • Instare Legal is not responsible if the user who completes the forms does not comply with the previous conditions.

4. Optional nature of filling out forms and veracity of the data provided

The different forms made available to you request all the data necessary to manage your query, so it is essential that you answer all the sections. If you do not answer these sections, we will not be able to correctly respond to your request.

5. Users rights

Consent and withdrawal

The user may withdraw the consents given at any time, without affecting the legality of data processing during the effective period prior to said authorization.

Right to access, rectify, erase, restrict, object and portability

The user or visitor may request the exercise of their rights of access, rectification or erasure, as well as in certain cases, if applicable, the restriction of the processing or portability of their data, as well as to object the processing of the data. All of this, in accordance with the aforementioned data protection regulations.

You can exercise your data protection rights by sending your request to Instare Legal, via email civil@instarelegal.com, or to the address indicated at the beginning of this document. If you wish, you can use the forms available at the Spanish Data Protection Authority website (www.aepd.es), or request a copy of them via email.

Requests to exercise rights made by users will be managed within a maximum period of one month. If you are not satisfied with the response given, you can file a claim with the aforementioned control authority. Your request will be responded to within a period of no more than 30 days. You can exercise your rights under the GDPR at any time.
